Agreement to Terms

By downloading, installing, or using VitalTile ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

VitalTile is a mobile application that displays health data from Apple Health in customizable home screen widgets. The App is designed to help you visualize and track your health metrics.

Health Information Disclaimer

VitalTile is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The health data displayed in VitalTile is sourced from Apple Health and is provided for informational and motivational purposes only. You should not rely on this information for medical decisions. Always consult with a qualified healthcare provider regarding any health concerns.

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.

License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control.

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices
  • Use the App for any unlawful purpose
  • Transfer your license to anyone else

In-App Purchases and Subscriptions

VitalTile offers optional in-app purchases and subscriptions ("VitalTile Pro") that unlock additional features. Purchases are processed by Apple through the App Store.

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions in your App Store account settings
  • Refunds are handled by Apple according to their refund policies
  • Prices may vary by region and are subject to change

Intellectual Property

The App and its original content, features, and functionality are owned by VitalTile and are protected by international copyright, trademark, and other intellectual property laws.

User Responsibilities

You are responsible for:

  • Maintaining the security of your device
  • All activity that occurs on your device related to the App
  • Ensuring you have proper permissions to access health data
  • Complying with all applicable laws when using the App

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We do not guarantee the accuracy, completeness, or reliability of any health data displayed in the App. Data accuracy depends on your input and Apple Health's data collection.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of your data
  • Any errors or omissions in the App's content
  • Any health decisions made based on information displayed in the App

Indemnification

You agree to indemnify and hold harmless VitalTile and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including breach of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VitalTile operates, without regard to conflict of law principles.
